LABOUR CONTRACT AGREEMENT

1. What This Agreement Is About

The Owner wants to build a Residential Building (Ground + 4 Floors) at the site located at: , , Bengaluru, Pin Code . The Contractor agrees to provide all necessary labour for this construction, following the drawings and specifications approved by the Owner.

2. The Work & Payment

2.1. Contractor's Work:

The Contractor will construct the Residential Building as per the approved drawings and specifications.

2.2. Contract Rate:

The Owner will pay the Contractor Rs. (Rupees ) for every square foot (Sq. Ft.) of the built-up area (slab to slab measurement) for all floors, including the ground floor.

2.3. What's Included in the Rate:

This rate covers all labour for the following works, including necessary tools, equipment, and supervision:

  • Marking work.
  • P.C.C. (Plain Cement Concrete) for foundations and flooring (as per structural needs).
  • R.C.C. (Reinforced Cement Concrete) for Footings, Pedestals, Plinth Beam, Columns, Lintels, Lofts, Chejjas (sun shades), Staircase, Roof Beams, Roof Slab.
  • Centering and bar bending for all R.C.C. work.
  • Size Stone Masonry (three courses below Plinth beam only).
  • 4, 6, 8 inch thick Block masonry for external and internal walls up to Roof level.
  • Lofts, Through Lintels & external Chejjas.
  • Fixing of Door frames, Grills, and Railings.
  • Internal Ceiling and Internal wall plastering with gurmal finish.
  • External plastering with Sponge finish.
  • Kitchen counter wall.
  • Parapet wall work up to 4 feet height with plastering.
  • Front Elevation work as per design (mesh work will be extra).
  • Curing for all the above works 2 to 3 times a day on working days.

2.4. What's NOT Included (Extra Work):

The following items are NOT included in the rate and will be charged extra:

  • Earth Work Excavation.
  • Excavated Earth filling.
  • Waterproofing for Toilets and sunken filling with 2 PCC concrete.
  • Sump Tank Construction (Labour cost: Rs. 5/Liter for Block work, Rs. 8/Liter for RCC work – *Please clarify what "Liter" refers to here, e.g., capacity of the tank*).
  • Compound wall work if it is outside the built-up area.
  • Front Drainage work with stone slab covering.
  • Waterproofing work for Terrace area with concreting and motor finish.
  • Sanitary Chamber Works with plastering (Each Chamber cost: Rs. 3000/-).
  • Additional Scaffolding work after Completion of civil work will cost extra (for Plumbing, Electrical, or texture work).
  • Watchman Salary (Rs. 4,000/- per month).
  • If any Alteration done after work done then cost will be extra.
  • Any work not specifically listed in Section 2.3 or shown in the approved drawings/specifications will be considered extra and require separate agreement.

3. Materials & Tools

  • Contractor's Responsibility: The Contractor will bring all necessary tools for the construction work.
  • Owner's Responsibility: The Owner will provide all construction materials (like Cement, Sand, Jelly, Steel, Blocks, Sponge, Joint mesh, Scaffolding rope, roof mat, Water Drum, Bucket, Tarpaulin, Stool, Cutting Blade, etc.) to the site on time.
  • Water & Electricity: The Owner will arrange for water and electricity supply at the site. (Specify who pays for electricity consumption if not included).

4. Payment Schedule

Payments will be made by the Owner to the Contractor periodically, as per a separate Payment Schedule.
You can find the detailed payment stages here: Appendix A: Detailed Payment Schedule. The area for payment will be calculated based on the work done on site.

5. Completion Time

The entire construction work completion time is **dependent upon the building size and number of floors**, as well as other factors.

6. Safety & Responsibility

The Contractor is fully responsible for any accidents during construction that result in injuries or loss of life to anyone (including neighbours, pedestrians, workers, or anyone near the site). The Contractor must follow all safety rules and take necessary precautions. The Contractor will protect the Owner from any claims related to such incidents.

7. Important Additional Points

  • Quality: All work must be of good quality and free from defects.
  • Defects Period: For after completion, the Contractor will fix any defects due to faulty workmanship at no extra cost.
  • Delays: If the Contractor delays the work without a valid reason, the Owner may apply penalties (e.g., a small percentage of the contract value per week of delay).
  • Disputes: Any disagreements will first be discussed amicably. If unresolved, they will be settled through arbitration in Bengaluru, as per Indian laws. The Courts in Bengaluru will have jurisdiction.
  • Termination: Either party can end this agreement under specific conditions (e.g., major breach of contract, long delays).
