  • Commencement date will be start from start of excavation work.

  • **Note:** Any delay in work activity for more than 1 month due to client payment issues, Client has reserved the right to terminate this agreement with contractor.

  • Subsequent Payments: In installments as per Schedule-C, based on progress of work stages, with Contractor providing 2 days' prior intimation. Payments to be mutually signed and recorded.
  • Final Payment: 2% of the total cost, to be settled at the time of building handover.
  • Payment Delay Grace Period: A grace period of 7 days will be given by the Contractor for payment delays after notification, after which the work will slow down but not stop.

Inclusions in Construction Cost (Rs. 1749/- Sft Package)

The construction cost for the Rs. 1749/- Sft package is inclusive of the following:

  • All construction materials
  • Labor charges
  • Laying of foundation
  • Carpentry works
  • Sanitation and plumbing
  • Painting (inside and outside the building)
  • Wooden doors and windows (both shutters and frames)
  • Electrical work
  • **Excludes:** Any interior works.

Owner's Scope & Extra Work

The following items are explicitly listed as extra costs or the Building Owner's responsibility, and are not included in the basic construction package:

  • Departmental & Site-Related Costs: Building plan approval & Tax fees, Temporary EB connection, Water facility for construction, Labor Shed, dealing with inconveniences/objections from authorities (Police, Corporation), Road Cutting And Main Cable, Meter Board.
  • Excavation & Foundation Related Costs: Soft soil soling cost (50% extra if required), size stone masonry work (if needed), hard rock/soft rock excavation (if it arises), water removing cost if water is found in footing (50% extra), sanitary pit (extra as per actual, if JCB not used for excavation).
  • Internal Fixtures & Finishes: All Final Fittings such as Fancy Lightings & ceiling Fans, Solar, Geyser, Mirror, Soap holder, Towel rod, Door back hanger hook etc. for Toilets/Bathrooms, all interior works and Plaster of Paris (POP) works (if any), Automatic Water level controller, Sump tank Motor.
  • External Structures & Features: Front Ramp (50% extra), Front elevation for Texture/cladding (if it exceeds Rs. 50,000.00), Grill enclosure for the boundary wall, Temporary structures like Pergola, sloping roof Works outside built-up area, Existing Building Demolishing work, Lift Expenditure (if applicable), Lift granite or tiles cladding (if applicable), Rainwater Filter, M.S.Ladder for Terrace.
  • Material & Work Alterations: Any changes in material specification will be as per materials selections and rates purchased. Any alterations that occur after work has been completed at the site will necessitate the payment of rework amounts by the Building Owners.
  • Unspecified Work: Work that is not stated in this quotation is considered to be under the client's scope.

General Conditions & Notes

  • The roof height will be 10'-6" from slab to slab, measured from the top of the lower slab to the Top slab of the upper slab.
  • Work will commence with earthwork excavation to prepare the site for construction.
  • A 10-year structural warranty will be provided, along with a 1-year warranty for waterproofing.
  • The warranty for fixtures will follow the terms set by the respective brands.
  • Any temporary structures constructed outside the built-up area will be considered additional work and will incur extra costs. These costs will be calculated based on actual materials, labor, and will be charged separately as per final measurements and site conditions. All such work must be approved by the owner before execution.
  • Any work not included in this package or outside the Built-up area will be charged extra.
  • Any changes in the rates for materials specified in the Specification then difference amount should be charged accordingly.
  • The Contractor will be entirely responsible for procurement, collection, and transport of all necessary materials including steel, cement, wood, tiles, granite, sanitary, electrical, plumbing items and any other.
  • All materials mentioned in the specifications shall be the best of their kind, in quality and usefulness. The decision of the Building Owners as regards the quality of materials shall be final.
  • The Contractor shall indemnify the owner in respect of all claims, damages, or expenses payable in consequence of any injury to any employee, workman, nominee, or invitee while in or upon the said premises. The Contractor shall also be responsible for any damage to buildings, whether immediately adjacent or otherwise.
  • The selection of Paint colors for interior and exterior walls, Wall and Floor tiles for Bathrooms, Wall tiles for Kitchens, Granite for the flooring and stairs, Tiles for the common areas like Parking lot shall be the choice of the Building Owners (with the consultation/suggestions from the Contractor).
  • The Contractor will submit relevant bills for purchases for warranty to the Building Owners.
  • This agreement shall be executed in duplicate; the original shall be retained by the owner and the duplicate by the Contractor.
  • Any alterations that occur after work has been completed at the site will necessitate the payment of rework amounts by the Building Owners.
  • Any Departmental objections, which arise during the course of construction for violations and other reasons, the owner shall negotiate with the concerned department.

Terms and Conditions

  • The client shall keep the site of construction free from all legal implications.
  • Water and electricity required for construction shall be arranged by client.
  • All charges to be paid to the respective departments and the changes in this connection have been included in the contract. Any increase in government charges to be paid by the client based on the bill presented by contractor.
  • The Builder shall arrange for the preparation of plan and estimate for the proposed building. Any increase in government charges to be paid by the client based on the bill presented by contractor.
  • Contractor should complete the construction work within 6 months from commencement of this contract. These six months includes any unforeseen delays due to rains, storm, labour strike, etc. Any delay in work activity for more than 1 month, Client has reserved the right to terminate this agreement with contractor.
  • Any delay in construction owing to client payment issues within six months of the contract's start date. Any budget-related increases in the cost of the building materials must be covered by the client. The Client shall not impose any rate escalation on the Contractor.
  • The payment clause should be adhered strictly to enable the Builder to go ahead with the completion of the construction of the entire building in time without any delay.
  • The Contractor will be responsible for repairing surface cracks or air cracks or damage which appears within 18 months from the completion.
  • Contractor will be held responsible for any deviation in the construction, since, the construction is as per the design agreed between the Client and Contractor.
  • The rates or the L.S amount accepted is valid for the normal period of Construction without any hindrance. The normal period of construction is as follows:
    • Only ground floor for 6 months.
    • For any additional floor there on extra period up to four months for each additional floor to be allowed.
  • Any increase in the building materials by budget, Scarcity, natural calamity or other unexpected activities the enhanced cost should be borne by the Contractor. No rate escalation shall be thrust upon on the Client by Contractor.
  • Any notice or correspondence to be sent to the Client under this Agreement shall be addressed and sent to the address mentioned in this Agreement and such notice and correspondence is deemed to have been served on the Client if addressed and sent by registered post or by courier or by personal delivery. The Builder is not responsible for delay or non-delivery due to change in the address if change of address is not intimated in writing.
  • All disputes, controversies or differences which may arise between the parties herein out of or in relation to or in connection with this agreement, the interpretation there of, or its breach that have not been resolved between the parties by mutual discussions shall be referred to arbitration. The venue of the arbitration shall be Chennai. The client and the builder shall appoint one arbitrator each of their choice and the arbitrators so appointed shall appoint a third arbitrator or, if they fail to appoint such third arbitrator, the competent court shall appoint a third arbitrator who shall act as the presiding arbitrator. The arbitration proceeding shall be conducted in accordance with and subject to the provisions of the arbitration& conciliationact,1996 or any modification or re-enactment thereof for the time being in force.
  • Both the parties agree that only the courts at Chennai shall have the exclusive jurisdiction to adjudicate upon matters relating to their rights and obligations of the parties under the terms of this Agreement.

Owner's Scope & Extra Work

  • External Structures & Features: Front ramp (50% extra), front elevation for texture/cladding (if it exceeds Rs. 50,000.00), electrical meter board and main wire and road cutting, compound wall (as specified in one document), grill enclosure for the boundary wall, temporary structures like pergola/sloping roof works outside built-up area, existing building demolishing work, lift expenditure (if applicable), lift granite or tiles cladding (if applicable), rainwater filter.

General Conditions & Notes

  • The roof height will be 10'-6" from slab to slab, measured from the top of the lower slab to the Top slab of the upper slab.
  • Work will commence with earthwork excavation to prepare the site for construction.
  • A 10-year structural warranty will be provided, along with a 1-year warranty for waterproofing.
  • The warranty for fixtures will follow the terms set by the respective brands.
  • Any temporary structures constructed outside the built-up area will be considered additional work and will incur extra costs. These costs will be calculated based on actual materials, labor, and will be charged separately as per final measurements and site conditions. All such work must be approved by the owner before execution.
  • Any work not included in this package or outside the Built-up area will be charged extra.
  • Any changes in the rates for materials specified in the Specification then difference amount should be charged accordingly.
  • The Contractor will be entirely responsible for procurement, collection, and transport of all necessary materials including steel, cement, wood, tiles, granite, sanitary, electrical, plumbing items and any other.
  • All materials mentioned in the specifications shall be the best of their kind, in quality and usefulness. The decision of the Building Owners as regards the quality of materials shall be final.
  • The Contractor shall indemnify the owner in respect of all claims, damages, or expenses payable in consequence of any injury to any employee, workman, nominee, or invitee while in or upon the said premises. The Contractor shall also be responsible for any damage to buildings, whether immediately adjacent or otherwise.
  • The selection of Paint colors for interior and exterior walls, Wall and Floor tiles for Bathrooms, Wall tiles for Kitchens, Granite for the flooring and stairs, Tiles for the common areas like Parking lot shall be the choice of the Building Owners (with the consultation/suggestions from the Contractor).
  • The Contractor will submit relevant bills for purchases for warranty to the Building Owners.
  • This agreement shall be executed in duplicate; the original shall be retained by the owner and the duplicate by the Contractor.
  • Any alterations that occur after work has been completed at the site will necessitate the payment of rework amounts by the Building Owners.
  • Any Departmental objections, which arise during the course of construction for violations and other reasons, the owner shall negotiate with the concerned department.
